Supreme Court Clarifies Protection for Dowry Givers in Harassment Cases
Top court says aggrieved parties will not face prosecution despite legal provisions criminalising dowry exchange
The Supreme Court has clarified that individuals who give dowry, particularly brides and their families, will be protected from prosecution if they are considered aggrieved parties under the law. Although the Dowry Prohibition Act criminalises both giving and receiving dowry, the court emphasized that legal protection for victims (पीड़ितों के लिए कानूनी सुरक्षा) [peediton ke liye kanooni suraksha] applies in such situations, especially when complaints involve domestic harassment claims (घरेलू उत्पीड़न शिकायतें) [gharelu utpeedan shikayatein].
This clarification came during the hearing of a plea filed by a man who argued that a First Information Report (FIR) should also be registered against his wife and her family. He pointed out that they had admitted to giving dowry in their complaint against him. However, the bench, comprising Justices Sanjay Kumar and K Vinod Chandran, rejected this argument, citing Section 7(3) of the law, which specifically addresses such scenarios. The court highlighted that statutory provisions (वैधानिक प्रावधान) [vaidhanik pravadhan] were designed to prevent misuse of criminal liability standards (आपराधिक दायित्व मानक) [aaparadhik dayitva maanak].
The Supreme Court explained that Section 7(3) was introduced to ensure that individuals who are forced to give dowry are not punished when they come forward with complaints. It recognized that victims often have to admit to giving dowry while reporting abuse, and punishing them for such admissions would discourage reporting.
